It is quite the conundrum. A law that was passed though unconstitutional, to be overturned by Judges that have no law making ability. Seems like it balances out to me. If Obama wants to illegally create laws, then they can be “illegally” dismantled. But the irony here is that is is not illegal for the Judges to deem a law unconstitutional. They will weigh the Constitution as it pertains to this new law and determine whether or not they think it is legal or illegal. If they determine it is illegal, then Congress can repeal it fully.
